The Nevada State Athletic Commissions (NSAC) Executive Director, Keith Kizer is, for lack of a better term, “the voice” of the NSAC. He is the man who is on the front lines of all things relating to the commission in Nevada that regulates the sport of Mixed Martial Arts and governs over UFC events in Las Vegas.
Kizer took to “Fight Club Radio” on the SiriusXM network a few days ago to discuss the developing story surrounding the Nick Diaz failed drug test situation. While on the air he outlined the process in which Nick will now have to go through as required by the commission.
Here is what he said:
“The complaints have been mailed to [Diaz]. He’ll receive the complaint by mail and he’ll have 20 days upon receipt to file an answer.
“With the complaint [for failed drug test findings], those are just allegations at this time. There’s been no finding against him. He’ll have ample opportunity to respond to the complaint and then we’d put it on for a hearing at a time that works for him as well as the Attorney General’s office.
Probably April (is when they will hear his case) based on past disciplinary complaints and at that time, there’ll be a hearing before the full commission and then they make a decision at that time and if they found the athlete guilty, they’d then impose whatever discipline they felt was appropriate.”
In short, Nick Diaz has been charged with a rule violation, but yet to be found guilty of these charges. Just like in a criminal case, charges are filed, heard before a judge and a verdict/punishment is then handed down.
While the NSAC came out and acknowledged his failed drug screening there is still much more work to do to put his disciplinary suspension in place and finalized.

As ridiculous as it may sound, I think it may come down to where Diaz smoked the weed. It’s legal in Cali and as everyone has said he has a legitimate card to hold and use it for medicinal purposes. If he smoked it in Cali, which he is allowed to do, then I think Nevada has to abide by its legality due to full faith and credit. I could be totally off-base, but I hope that is the case. Curious to see how this all plays out though.
Legal in California, but illegal on a federal level. State law does not override federal law. Dea can still go in and raid these “legal” grow houses whenever they want. Nick is not getting out of this.
It doesnt matter where he smoked it, state and/or federal laws have nothing to with game comission rules. Weed could be legal in every state and even on the federal level but if the game commision wants it to be a banned substance for a sport then its banned. There are several drugs that anybody can buy legaly anywhere, but they are considered banned substances if you want to fight proffesionally or play a sport.

Why would the Nevada State Athletic Commission have to recognize CA state law? That’s ridiculous. In order to fight in NV, a fighter needs to apply for, and be granted a license by the NSAC. Are you people defending Diaz under the impression that he wasn’t given the rules and regulations by the state and that he wasn’t required to sign anything saying that he would abide by those rules? He knows that he has to submit to a drug test for banned substances after the fight and pot is a banned substance in every state athletic governing body. And it’s not his first offense so he has no excuse. He’s just plain bad for the sport.
